التكييف الفقهي للوصية بالعضو الإنساني

إن موضوع التبرع بالأعضاء الآدمية بأبعاده المعاصرة من أجل غرسها، موضوع حساس لأنه يتصل بالأحياء والأموات، خاصة مع الطفرة النوعية التي عرفها الطب وعلم الجراحة في العشرين عامًا الماضية مما فتح آفاقًا جديدة في هذا الميدان، والتي منها مسألة الوصية من أجل التبرع بالعضو البشري، وهي مسألة مستجدة ولا يتوقع أن يكون الفقهاء قديما قد تعرضوا لبحث حكمها الشرعي، ومن هذا المنطلق ارتأينا أن نعرض موقف فقهاء المسلمين حول مسألة الوصية بأعضاء الآدمي حال حياته لما بعد مماته.

Juristic Adaptation of The will to donate to the human organ:

Abstract:

Human organs donation for transplantation (with its modern perspectives) is a very sensitive subject due to its direct relation with both the dead and the living, and especially with the revolutionary advancement that the medical science had achieved in the last twenty years. As a result, new subjects of discussion made appearance. The will to donate organs is one of these subjects, and it is not expected that old scholars had had a chance to make researches about it according to Islamic law. Starting from this, we wanted to present the views of different Muslim scholars about making a will to donate organs after the death of a person.

نشأة المذهب الحنفي ورئاسة الفتوى الحنفية في عهد الدولة العثمانية وما بعدها بإيفريقية "تونس حاليا" 

-عهد البايات المراديين والدايات الحسينيين والحماية الفرنسية-.

ملخص:

يعتبر المذهب الحنفي المذهب الثاني بعد المذهب المالكي الذي يسود في بلاد إفريقية (تونس حاليا)، ونحن سنسلط الضوء في هذا البحث على: بداية انتشار المذهب الحنفي ونشأته الأولى في تونس، ثم تواجد المذهب الحنفي في مرحلة الحكم الحفصي، ثم المذهب الحنفي في عهد الدولة العثمانية (البايات المراديين والدايات الحسينين) إلى غاية الاحتلال الفرنسي، ثم المراحل التي مرت بها رئاسة الفتوى الحنفية ومن نُصِّب للفتيا في كل مرحلة؛ ثم خاتمة أوضح فيها جميع النتائج المتوصل إليها، وبعدها المصادر والمراجع المعتمدة في البحث، فاستعنت بالله عزوجل وعزمت على جمع شتات هذا الموضوع بما يعطيه حقَه وبما يوضح مبهمه ويكشف عن مستُوره، حتى تكون بذلك دراسة شاملة لما يُبحث بتفصيل وزيادة والله هو الموفق.

ORİGİNATİON OF THE HANAFİ DOCTRİNE AND THE PRESİNDENCY OF THE FATWA OF THE DOCTRİNE DURİNG THE RULİNG OF THE OTTMAN EMPİRE(THE SIR” S MURAT THE HUSEYNI DAYAT AND FRENCH PROTECTION).

Abstract:

The Hanafi doctrine is consideied the second most popular doctrine after the maliki in the Afrikiyah country (Tunisia today).In this reaserch we will look into how the doctrine started and became popular in Tunisia, its existence during the Hafsi ruling,then its exiStence during the ruling of the ottman empire(the Murat sirs and the Huseyni dayat).we will then look into the steps through which the presidency of the doctrine went through and who was appointed to give fatwas each time finally, we clarified the out comes.

Of this research and included the resourses and references which helped complete this reaserch.

Through the help of allah, we were able to gather different resources that would help clarify and explain the hidden points and important details of this topic.

-دراسة تاريخية مقاصدية نموذجية لبعض مقالات المجلة الزيتونية -

الملخص:

إنّ المقاصد ليست بتلك المنتظمة بربانها في فلك سلك البيان ولا بالملقاة في فيافي الإبهام، وإنّما يتصدى لها العلماء الراسخون لبيانها كحال مشايخ الزيتونة، فالغائص في بعض مقالاتهم المنثورة في مختلف أبواب المجلة الزيتونية يجد لهم مادة علمية ثرية ذات صبغة مقاصدية بحته، يتجلى فيها حرصهم الدؤوب للكشف عن المقاصد والسعي من أجل تفعيلها ثم الارتقاء بها، سالكين طريق ملهمهم الشيخ ابن عاشور فنقبوا عما كشف عنه من مقاصد خاصة وسبروها، وتتبعوا الكليات والجزئيات واستقرؤوا مواضعها، ووضعوا لها الشروط والضوابط حتى لا تختلط المقاصد بالوسائل ولا الكليات بالجزئيات، وبينوا المنهج اللازم الاتباع في الكشف عن المقاصد وسبيل تفعيلها والرقي بها.

THE ESSENTIAL ROLE OF SOME OF THE SHEIKHS OF AL-ZAYTOUNA MOSQUE IN APPLICATION OF THE PURPOSES OF THE SHARIA DURING THE PERIOD OF THE FRENCH OCCUPATION

-          A historical study, and in reference to some  artıcles from ” Zaytounah Journal” of Al-Zaytouna Mosque-

Abstract:

Explanation of the purposes (of Shariah) is not for men of hands with all thumps neither it is for incompetent hands. But it can only be addressed by well-established scholars such as the Sheikhs of Al-zaytounah. The readers of some of their articles published in various sections of the Zaytoun Journal would find out that numbers of their scholarly materials are related to the pursposes (of Shariah). This reflects their enthusiasm to reveal the purposes (of shariah) and strive to apply it and then upgrade it. In doing that, they trudged the path inspired by Sheikh Ibn Ashour, and they explored and revealed the purposes (of Sharia) with all precision. They examined the unexpurgated and the expurgated (shariah texts) and read their position (in the principles of fiqh). They set up  conditions and regualtions so as not to mix up the purposes with the means, and not the unexpurgated and the expurgated (shariah texts). And they explained the necessary methods to follow in the discovery the purposes (of shariah) and the ways to apply and upgrade them.

موقف محمد آركون من القرآن الكريم من خلال مشروعه الفكري "الإسلاميات التطبيقية"

الملخص : إن الساحة الثقافية في وقتنا المعاصر تعرف جدلا كبيرا حول ما يمكن تسميته بالقراءات الجديدة للقرآن الكريم أو القراءات الحديثة للقرآن الكريم والتي اتخذت من النص القرآني محورا لها، وفي هذا النطاق جاءت مجموعة من كتابات الدكتور محمد أركون-رحمه الله-، فأردنا أن نسلط الضوء حول بعض كتبه ونصوص محاضراته، حتى نستطيع أن نعرف معرفة شاملة لبعض مواقفه التي اتخذها اتجاه القرآن الكريم واضعين نصب أعيننا مشروعه الفكري الطموح "الإسلاميات التطبيقية" التي جسدها من خلال إنتاجه الفكري وتحركه الثقافي، وبذلك يمكننا التعرف على مدى إيجابية مواقفه المتبناة في قراءته لنصوص القرآن الكريم.

Abstract: The scholarly arena in our contemporary time witnesses a great debate about what can be called

 new ways of reading the Holy Quran or the modern methodologies of the Holy Quran reading which takes its emphasis from the Quran text. In this scope emanated a collection of writings of Dr.Muhammad Arkoun (may Allah have mercy on him). We therefore aim to shed more light on some of his books and the scripts of his lectures. This will provide us with a comprehensive knowledge of his views concerning the Holy Quran, taking into consideration his ambitious intellectual project "Applied Islamism"; which embodies his intellectual views and his scholarly efforts. In this way, we can ascertain how positive his adopted positions are in reading the texts of the Holy Quran.
